Agent for Executor vs. Trust Company: Which Is Right for You?
If settling an estate feels like too much to handle alone, you have two main professional options: hire an Agent for Executor, or step aside so a trust company can act. They solve the same problem in very different ways.
Agent for Executor: you keep the role
You stay the executor and make every decision. The agent does the work under your direction: inventories, notices, paperwork, coordinating appraisers and realtors, record keeping and preparing documents for distribution.
You keep control and stay informed
You choose full service or help with specific tasks
Fees are agreed in advance, often as a percentage of the estate value the agent handles for you
You still sign key documents and remain legally responsible
Trust company: they take the role
A trust company acts as executor itself, either because the will names it or because you renounce and it is appointed. It takes over responsibility and decision making.
Responsibility and liability move to the trust company
Fees are often a percentage of the estate's value
Less personal involvement, and less control for the family
Which fits your situation?
An agent usually fits when you are willing to stay in charge but need time, expertise or local presence. A trust company may fit when no family member can or should act, or when the estate is large and complex with real conflict among beneficiaries.
